Welcome to 100 DOTS. These Terms of Service ("Terms") govern your use of the 100 DOTS website and subscription service (collectively, the "Service") operated by 100 DOTS ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Subscription and Billing
1.1 Subscription Plans
100 DOTS offers a monthly subscription for $9.00 USD per month. Your subscription grants you access to all 100 listening guides ("Dots") within the classical music journey, including related content, progress tracking, and community features.
1.2 Billing and Renewal
Subscriptions are billed on a recurring monthly basis. Your subscription will automatically renew at the start of each billing cycle unless and until you cancel. By providing a payment method, you authorize us to charge the subscription fee to that payment method on each renewal date.
1.3 Cancellation Policy
You may cancel your subscription at any time from your account settings or by contacting us at 100dots@polsia.app. If you cancel:
- Your cancellation takes effect at the end of the current billing period.
- You retain full access to the Service until the end of the period for which you have already paid.
- After the billing period ends, your account reverts to the free tier with access to the first 25 dots (Genesis section).
- We do not issue partial-month refunds for unused time within a billing cycle.
1.4 Failed Payments
If a payment fails, we will notify you and attempt to retry the charge. If payment is not received within a reasonable period, your subscription may be suspended or canceled. We reserve the right to disable access to premium content during any period of non-payment.
2. Accounts
2.1 Account Registration
To subscribe, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at 100dots@polsia.app if you suspect unauthorized use of your account.
2.2 Account Eligibility
You must be at least 16 years old to create an account. By registering, you represent that you are able to form a binding contract and are not prohibited from doing so under applicable law.
2.3 Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, including for fraudulent activity, harassment, or misuse of the Service. We may also terminate accounts that remain inactive for an extended period.
3. Content and Intellectual Property
3.1 100 DOTS Content
The listening guides, text, metadata, and original content created by 100 DOTS are our property. You may not reproduce, distribute, or create derivative works from this content without our written permission. You retain the right to share your personal experience and impressions of the content.
3.2 Third-Party Content and Links
100 DOTS includes links to third-party streaming services (including but not limited to Spotify and YouTube) and external resources. These third-party services are governed by their own terms and privacy policies. We do not control, endorse, or take responsibility for third-party content or services.
3.3 Music Streaming Services
The music linked from the Service is owned by its respective composers, performers, and record labels. 100 DOTS does not claim ownership over any musical works. Your use of third-party streaming services is subject to those services' own terms of use.
3.4 User Content
You may post comments and discussion contributions on the Service. You retain ownership of content you create. By posting, you grant us a non-exclusive, royalty-free license to use, display, and distribute your contributions in connection with the Service.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Infringe on the rights of others, including intellectual property rights.
- Distribute malware, viruses, or other harmful code.
- Scrape, harvest, or systematically collect content or user data.
- Use the Service for commercial purposes not affiliated with 100 DOTS without our written permission.
- Harass, defame, or abuse other users.
- Attempt to gain unauthorized access to the Service or its underlying systems.
5. Availability and Changes
We strive to keep the Service available and functional. However, we do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time with reasonable notice where practicable.
We reserve the right to modify these Terms at any time. Material changes will be communicated by posting an updated version on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
6. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted.
100 DOTS is not a music streaming service and does not provide or host audio content. All music referenced on the Service is provided by third-party streaming platforms.
7. Limitation of Liability
To the maximum extent permitted by law, 100 DOTS and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or other intangible losses, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which 100 DOTS operates, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the competent courts of that jurisdiction.
